These Terms of Service and Conditions ("Terms," "Agreement," or "T&C") are presented to you BEFORE you submit your travel planning request form. By submitting your online travel planning form, completing payment information, or using any service provided by Icon Tours, LLC (operating as IconTours.com, "Company," "we," "us," or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms.
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT SUBMIT YOUR FORM OR REQUEST OUR SERVICES.
These Terms govern the relationship between you ("Customer," "you," or "your") and Icon Tours, LLC. These Terms are comprehensive, and certain sections contain important limitations on and waivers of liability. We strongly recommend that you read them in full and consult a legal advisor if you have any questions.
1. NATURE OF OUR SERVICES
1.1 We Are a Travel Planning Facilitator, Not a Package Tour Organizer
Icon Tours, LLC provides travel planning and arrangement services for customers interested in booking individual travel components and curated experiences. We act as a travel planning intermediary and facilitator that:
Helps you research, plan, and arrange individual travel services and experiences.
Coordinates with third-party service providers (hotels, tour operators, guides, transportation companies, activity providers, airlines, etc.) on your behalf.
Provides recommendations and curates itineraries based on your preferences.
Processes bookings and payments through our online forms and platform.
Offers travel planning consultations and customer support.
1.2 Independent Service Providers
All travel services, accommodations, activities, tours, transportation, and vendor services you book through our platform are provided by independent third-party service providers ("Service Providers" or "Vendors"), who are not employees, agents, or representatives of Icon Tours, LLC. These Service Providers include (but are not limited to):
Accommodation providers (hotels, guesthouses, vacation rentals, resorts).
Tour and activity operators.
Professional guides and drivers.
Airlines and transportation companies.
Restaurant and dining services.
Cultural attraction operators.
Insurance providers.
Any other vendors offering services through our platform.
1.3 Direct Contracts with Service Providers
When you book any travel service through IconTours.com, your contract for that specific service is concluded directly between you and the relevant Service Provider, not with Icon Tours, LLC. Icon Tours, LLC acts as your booking intermediary and commercial agent to facilitate these arrangements. We receive a commission from Service Providers for arrangements we facilitate. The price you pay includes all applicable commissions earned by Icon Tours, LLC.
1.4 No Guarantee of Service Provider Performance
Icon Tours, LLC does not:
Operate, own, manage, or directly control any travel services, accommodations, activities, or transportation.
Employ or supervise Service Providers.
Set, establish, or verify safety standards for activities.
Guarantee that Service Providers will perform their services satisfactorily or at all.
Warrant the quality, safety, legality, or compliance of services provided by third parties.
Provide travel insurance as part of our services (see Section 9 regarding optional insurance).
2. CUSTOMER RESPONSIBILITIES
2.1 Travel Documents and Requirements
You are solely responsible for:
Obtaining and maintaining valid travel documents (passports, visas, travel permits) for all destinations on your itinerary.
Meeting all health and entry requirements for all countries you will visit (vaccinations, health declarations, COVID-19 requirements, etc.).
Obtaining required visas well in advance of travel dates.
Understanding currency exchange requirements and customs regulations.
Complying with all laws and regulations of the countries you visit.
Traveling only to destinations where travel is legal and advisable according to your government.
Providing accurate information in your travel planning form.
Icon Tours, LLC is not responsible for denied entry, visa rejections, health requirement non-compliance, or any consequences arising from your failure to obtain proper documentation or meet entry requirements.
2.2 Pre-Existing Health Conditions
You are responsible for:
Disclosing any medical conditions, mobility limitations, or health requirements during the booking process.
Obtaining medical clearance from your healthcare provider before traveling.
Carrying all necessary medications and medical equipment.
Obtaining appropriate medical insurance (see Section 9).
Informing Service Providers (guides, hotels, activity operators) of health conditions that may affect your participation.
Icon Tours, LLC and Service Providers are not liable for health complications, allergic reactions, or medical emergencies arising from undisclosed or misrepresented health conditions.
2.3 Assessment of Your Own Fitness and Capability
By booking any travel activity, you represent that:
You are in good physical and mental health and capable of participating in the activities you book.
You have assessed your own physical abilities and fitness level.
You have read all activity descriptions and understand the physical demands, risks, and requirements.
You have confirmed that you can safely participate in activities involving outdoor elements, altitude, water, hiking, adventure sports, or other special activities.
You understand the risks inherent in travel, including, but not limited to, unfamiliar environments, varying climate conditions, transportation risks, activity risks, and exposure to new foods and customs.
You acknowledge that some activities may involve inherent and unavoidable risks, including physical exertion, exposure to the elements, altitude changes, water activities, travel in unfamiliar areas, and adventure sports. Icon Tours, LLC and Service Providers are not liable for injuries or health complications arising from your decision to participate in activities beyond your fitness level or capability.
3. TRAVEL INSURANCE - MANDATORY REQUIREMENT
3.1 Insurance Is NOT Included
Travel insurance is NOT included in any service Icon Tours, LLC arranges. You will be presented with optional travel insurance during your booking form submission. This insurance is provided by our insurance partner(s) and is optional for you to purchase.
3.2 Insurance Requirements and Recommendations
We strongly require and recommend that you purchase comprehensive travel insurance before traveling. Insurance should include:
Emergency medical coverage (minimum €30,000 for Schengen area travel, higher for distant regions).
Emergency repatriation and evacuation (medical transport to home country if seriously injured).
Trip cancellation and interruption (if you must cancel before departure or cut your trip short).
Travel delay and baggage loss (coverage for lost luggage and delayed arrival).
Personal liability (if you cause injury to others or damage to property).
Activity-specific coverage (if participating in adventure sports, high-altitude activities, or extreme activities).
3.3 Responsibility for Your Own Insurance
If you decline the optional insurance offered at the time of booking, you are entirely responsible for obtaining your own travel insurance. This is non-negotiable. Icon Tours, LLC assumes no responsibility for your lack of insurance coverage.
Icon Tours, LLC is not liable for:
Your decision not to purchase travel insurance.
Any losses, damages, or costs arising from lack of insurance coverage.
Any claims you cannot recover because you did not have appropriate insurance.
The cost of emergency medical evacuation or repatriation.
Losses from trip cancellation, trip delay, lost luggage, or other insurable events.
3.4 Insurance Does Not Limit Our Liability Limitations
Your purchase of travel insurance does not change or limit the liability limitations set forth in these Terms. Icon Tours, LLC's liability limitations apply whether or not you have purchased insurance.
4. LIMITATION OF LIABILITY - GENERAL EXCLUSIONS
4.1 Icon Tours Is Not Liable for Service Provider Performance
Icon Tours, LLC is NOT liable, and you cannot recover from Icon Tours, LLC, for:
Any failure by any Service Provider (accommodation, tour operator, guide, airline, restaurant, activity operator, etc.) to perform or properly perform their services.
The quality, safety, or adequacy of services provided by Service Providers.
Missed or delayed transportation, late arrivals, and early departures.
Overbooking or denied service by airlines or accommodation providers.
Service cancellations by Service Providers.
Refusal of entry by any country or Service Provider.
Damage to, theft of, or loss of your personal property or luggage.
Loss, delay, damage, or mishandling of baggage by airlines or transportation providers.
4.2 Events Beyond Our Control (Force Majeure)
Icon Tours, LLC is not liable for any failure or inability to provide our planning services, or any losses you experience, caused by events beyond our reasonable control, including:
Severe weather, natural disasters, earthquakes, floods, hurricanes, tornadoes.
Acts of God or natural events.
War, terrorism, civil unrest, riots, strikes, and government actions.
Pandemics, epidemics, or health emergencies.
Government-issued travel warnings or bans.
Border closures or mobility restrictions.
Airline strikes or transportation disruptions.
Power outages or internet failures.
Cyberattacks or system failures.
Labor disputes.
Any other circumstances beyond our reasonable control.
In case of force majeure events, Icon Tours, LLC will make reasonable efforts to assist you, but we are not liable for any losses you incur.
4.3 Activities and Inherent Risks
You acknowledge that all travel activities involve inherent and unavoidable risks. Icon Tours, LLC is not liable for:
Injuries, illness, or death arising from or related to any travel activity or experience.
Personal injury or bodily harm during activities.
Physical exertion-related injuries or health complications.
Weather-related injuries or exposure.
Water activities (swimming, snorkeling, diving, boating) risks and drowning.
Adventure-sport risks (hiking, climbing, etc.).
Travel-related psychological distress, anxiety, or emotional harm.
Altitude sickness or climate-related illness.
Food-related illness or allergic reactions.
Injuries from animal encounters.
Losses from activity cancellations due to weather or circumstances.
You assume all risks associated with travel and participation in activities.
4.4 Crimes Against You - Third-Party Actions
Icon Tours, LLC and Service Providers are not liable for:
Theft, robbery, pickpocketing, or theft of personal belongings.
Crimes committed against you by third parties (assault, fraud, scams, extortion).
Kidnapping or other violent crimes.
Sexual assault or harassment.
Fraud or overcharging by Service Providers or local vendors.
Unsafe conditions in areas you visit.
Crime risks in the destinations you choose to visit.
You are responsible for assessing crime risks in destinations, taking reasonable precautions, and using common travel safety practices. Icon Tours, LLC and Service Providers are independent of, and not responsible for, the criminal acts of third parties.
4.5 Psychological, Mental Health, and Emotional Harm
Icon Tours, LLC is not liable for:
Emotional distress, anxiety, depression, or PTSD arising from travel.
Homesickness or loneliness during travel.
Travel fatigue or jet lag.
Stress from travel delays, missed connections, or service failures.
Emotional distress from animal encounters, cultural differences, or unfamiliar environments.
Psychological harm from travel experiences.
Mental health crises during or after travel.
You acknowledge that travel can be physically and emotionally challenging and may expose you to unfamiliar cultural practices, animals, foods, and environments.
4.6 Time, Delays, and Schedule Changes
Icon Tours, LLC is not liable for:
Flight delays, cancellations, or missed connections.
Long layovers or travel delays.
Time lost during travel.
Delays caused by weather, airline operations, or transportation providers.
Changes to schedules or itineraries made by Service Providers.
Early-morning departures or late-evening arrivals.
Your own tardiness or failure to arrive on time for scheduled services.
Lost time due to slow internet, email delivery delays, or communication failures.
4.7 Illness, Injury, Hospitalization, and Medical Treatment
Icon Tours, LLC is not liable for:
Illness or disease contraction during travel (food poisoning, traveler's diarrhea, infectious diseases, COVID-19, malaria, dengue, etc.).
Injuries sustained during travel for any reason.
Hospitalization or medical treatment costs required during travel (emergency medical expenses are often extremely high).
Emergency evacuation or repatriation costs if you require medical transportation.
Medication complications or health condition deterioration.
Pre-existing conditions worsen during travel.
Mental health crises or psychological breakdowns during travel.
Death from any cause during travel.
4.8 Venue Closures and Service Unavailability
Icon Tours, LLC is not liable for:
Attraction closures (museums, cultural sites, and natural attractions closing unexpectedly).
Restaurant or service provider closures.
Service unavailability on the dates of your visit.
Changes to attraction hours or accessibility.
Maintenance closures or unexpected service suspensions.
Vendor or attraction decisions to deny you service.
4.9 Vendor-Provided Services Failures
Icon Tours, LLC is not liable for:
Refusal of services by vendors (hotels denying your reservation, restaurants refusing to serve you, tour operators canceling tours).
Poor quality service from Service Providers.
Unsafe conditions in accommodations.
Lack of cleanliness or inadequate facilities.
Overbooking by accommodations or activity providers.
Misrepresentation by Service Providers.
Any vendor's failure to meet expectations or advertised standards.
5. ASSUMPTION OF RISK AND WAIVER
5.1 Assumption of Risk
By submitting your travel planning form and booking travel services through IconTours.com, you:
Voluntarily assume all risks associated with travel to your chosen destinations.
Acknowledge that travel involves inherent risks that cannot be eliminated.
Accept responsibility for assessing risks and making informed decisions about destinations and activities.
Understand and accept the physical, health, and safety risks involved.
Accept the possibility of injury, illness, or death during travel.
Accept the financial risks of losses not covered by insurance.
5.2 Waiver and Release of Claims
You hereby waive, release, and discharge Icon Tours, LLC and its owners, managers, employees, agents, and representatives (collectively, "Released Parties") from any and all claims, demands, causes of action, damages, and losses arising from or related to:
Your use of our travel planning services.
Any travel services you book through IconTours.com.
Any injuries, illness, death, or property damage you experience during travel.
Service failures, cancellations, or changes by Service Providers.
Any actions or omissions of Service Providers.
Your travel experiences and all aspects of your trip.
Any losses or damages of any kind related to your travel.
This waiver applies to all claims, whether or not you have purchased travel insurance, and regardless of whether your travel insurance covers the losses.
5.3 Release of Unknown Claims
To the fullest extent permitted by law, you release Icon Tours, LLC from liability for claims you do not currently know of, even if those claims arise from negligence or breach of duty by Icon Tours, LLC.
5.4 Waiver of Legal Protections
You acknowledge that by accepting these Terms, you may be waiving important legal protections and rights to sue Icon Tours, LLC. You have the opportunity to consult with an attorney before accepting these Terms.
6. COMPREHENSIVE INDEMNIFICATION CLAUSE
6.1 Indemnity by Customer
You agree to indemnify, defend, and hold harmless Icon Tours, LLC, its owners, directors, managers, employees, agents, representatives, and affiliates (collectively, "Indemnified Parties") from and against any and all claims, damages, liabilities, costs, and expenses, including reasonable attorneys' fees and court costs, ("Claims and Damages") arising from, related to, or connected with:
A. Your Actions and Omissions
Your intentional or negligent acts, errors, or omissions.
Your violation of any applicable laws, regulations, or rules.
Your violation of any third-party rights.
Your failure to comply with these Terms or applicable laws.
Your misrepresentation of information in your travel planning form.
Your undisclosed health conditions, fitness limitations, or medical needs.
Your poor judgment or risky behavior during travel.
Your violation of cultural norms or local laws in destinations.
B. Third-Party Claims and Injuries
Claims by third parties arising from your actions or conduct.
Claims by third parties for bodily injury, property damage, or death you cause.
Your personal injuries or illnesses and the claims you assert for those injuries.
Your property damage, losses, or theft.
Losses you claim from Service Providers.
Claims arising from activities you choose to participate in.
Claims from crimes committed against you.
Claims for your emotional distress or psychological harm.
C. Specific Loss Categories Requiring Indemnification
You specifically agree to indemnify Icon Tours, LLC for any and all claims related to:
Personal Injury and Death: Any claim arising from bodily injury, illness, or death you experience during travel, regardless of cause, whether from activity participation, accidents, crime, disease, or any other source.
Property Damage and Theft: Claims for damage to, theft of, or loss of your personal property, luggage, valuables, documents, or money.
Loss of Personal Items: Any financial losses from theft, loss, or damage to personal belongings, including phones, cameras, jewelry, watches, glasses, medications, documents, or cash.
Crimes and Criminal Activity: Claims arising from crimes committed against you, including theft, assault, fraud, sexual assault, kidnapping, or other criminal acts.
Time Lost and Delays: Any claim for time lost due to travel delays, missed flights, missed services, activity cancellations, or itinerary changes (even though money damages for "lost time" are typically unavailable).
Psychological and Emotional Injury: Claims for emotional distress, anxiety, depression, PTSD, homesickness, culture shock, or any psychological harm.
Physical and Psychological Injuries: Any bodily or mental injury, whether temporary or permanent, including injuries from participation in activities, accidents, falls, or any physical harm.
Guest and Companion Injuries: Any injuries or claims arising from companions, family members, or other guests traveling with you.
Transportation Losses: Any losses from airline delays, cancellations, missed connections, baggage mishandling, or transportation changes.
Hospitalization and Medical Costs: Any claims for emergency medical treatment, hospitalization, surgery, medications, or medical expenses incurred during travel.
Illness and Disease: Any claims from the contraction of illness, disease, infection, or virus during travel.
Vendor Service Failures: Any claim arising from Service Provider failures to perform, cancellations, poor quality, or refusal of service.
Accommodation Issues: Any claims arising from accommodation problems, safety concerns, theft, or other accommodation-related losses.
Food and Beverage: Claims for food poisoning, allergic reactions, or illness from dining services.
Activity Cancellations: Claims for refunds or alternative compensation due to activity cancellations, regardless of cause.
Attraction Closures: Claims arising from unexpected closures of attractions, museums, or venues you planned to visit.
Overbooking and Denial of Service: Claims from airlines, hotels, or service providers denying you service or overcharging you.
7. INDEMNIFICATION PROCEDURES AND CONDITIONS
7.1 Indemnification Applies Fully
Indemnification is required of you whether or not:
You have purchased travel insurance.
Your travel insurance covers the claim or loss.
Icon Tours, LLC carries insurance for the claimed loss.
Icon Tours, LLC was negligent or contributed to the loss.
The claim involves unknown risks or surprising circumstances.
You cannot afford to pay the damages yourself.
7.2 Scope of Indemnification
Your indemnification obligation includes:
All types of damages: Direct damages, indirect damages, consequential damages, and incidental damages.
All costs: Attorneys' fees, court costs, investigation costs, expert witness fees, and settlement costs.
All types of claims: Third-party claims against Icon Tours, LLC, claims by other travelers, and claims by family members.
Insurance deductibles: Icon Tours, LLC's insurance deductibles and related claim expenses.
7.3 Indemnification Survives Dispute
Your obligation to indemnify Icon Tours, LLC continues even if Icon Tours, LLC and you dispute:
Whether Icon Tours, LLC was responsible for the loss.
Whether the loss was foreseeable.
Whether you had insurance coverage.
The amount of damages.
8. LIMITATION OF LIABILITY - DAMAGES CAPS
8.1 Limited Liability Generally
To the maximum extent permitted by law, Icon Tours, LLC's total liability arising from or related to your use of our services or any bookings made through IconTours.com is limited to the amount you paid to Icon Tours, LLC for travel planning services. This amount is typically much less than any damages you might claim.
8.2 No Liability for Indirect or Consequential Damages
Icon Tours, LLC is not liable for:
Lost profits, lost revenue, or lost business opportunities.
Lost data or information.
Lost enjoyment of travel.
Lost wages or lost income.
Emotional distress or mental anguish.
Punitive or exemplary damages.
Any indirect, incidental, special, or consequential damages.
This applies even if Icon Tours, LLC was advised in advance that such damages were possible.
8.3 Liability Limited Despite Negligence
These liability limitations apply even if Icon Tours, LLC was negligent, breached its duty of care, or failed to provide services promised. The only exceptions are for:
Gross negligence or intentional misconduct by Icon Tours, LLC.
Fraud by Icon Tours, LLC.
Violations of law that cannot be waived (such as certain mandatory consumer protections).
9. TRAVEL INSURANCE - OPTIONAL ADD-ON
9.1 Insurance Offered During Booking
During your travel planning form submission, you will be presented with optional travel insurance policies offered by our insurance partner(s). This insurance is:
Optional, not mandatory, or included in Icon Tours, LLC's services.
Your choice to purchase or decline.
Provided by a third-party insurance company, not by Icon Tours, LLC.
Subject to the insurance company's terms, conditions, exclusions, and limitations.
9.2 If You Purchase Insurance
If you elect to purchase travel insurance:
The insurance premium will be added to your total cost.
You will receive insurance policy documents with detailed coverage information.
You are responsible for understanding what is and is not covered.
Insurance claim procedures and limitations are governed by the insurance policy, not by Icon Tours, LLC.
Icon Tours, LLC is not responsible for insurance claim denials or delays.
9.3 If You Decline Insurance
If you choose not to purchase the optional travel insurance offered by us:
You are entirely responsible for obtaining your own travel insurance from another provider.
Icon Tours, LLC assumes no responsibility for your lack of coverage.
You cannot later claim damages from Icon Tours, LLC based on your failure to purchase insurance.
Your travel insurance decision does not affect Icon Tours, LLC's liability limitations in these Terms.
10. SERVICE PROVIDER DISCLAIMERS
10.1 We Do Not Control Service Providers
Icon Tours, LLC does not:
Own, operate, manage, or directly control any accommodations, attractions, tours, or other travel services.
Employ or supervise Service Providers, guides, or activity leaders.
Set, establish, verify, or monitor safety standards.
Warrant that Service Providers will perform their contractual obligations.
Screen, audit, or perform background checks on Service Providers or guides.
Ensure that Service Providers meet any specific quality or safety standards.
Inspect accommodations, transportation, or activity sites for safety.
10.2 Vendors' Terms and Conditions
When you book any service through IconTours.com, you may be required to agree to the Service Provider's terms and conditions ("Vendor T&Cs"). Vendor T&Cs may include:
Additional liability limitations.
Specific cancellation policies.
Activity-specific waivers.
Safety disclaimers.
Refund policies.
By booking, you agree to be bound by any applicable Vendor T&Cs. If there is a conflict between these Terms and any Vendor T&Cs, the provision most protective of Icon Tours, LLC's interests will apply.
10.3 No Representation of Vendor Quality
Icon Tours, LLC makes no representations, warranties, or guarantees regarding:
The quality of services provided by Service Providers.
The safety of accommodations, tours, or activities.
The competence or background of guides, drivers, or activity leaders.
Vendor compliance with health, safety, or other regulations.
Vendor adherence to promised service standards.
The authenticity or accuracy of vendor descriptions or advertising.
11. NO WARRANTIES - SERVICES PROVIDED "AS IS"
11.1 No Express Warranties
Icon Tours, LLC provides travel planning services "as is" without any express warranties. We do not warrant that:
Our services will meet your expectations.
Our recommendations will be to your liking.
Services will be provided without errors or delays.
Information on our website is always accurate and up-to-date.
Our website or systems will be error-free or uninterrupted.
11.2 No Implied Warranties
To the maximum extent permitted by law, Icon Tours, LLC disclaims all implied warranties, including:
Warranty of Merchantability – that our services are of reasonable quality.
Warranty of Fitness for a Particular Purpose – that our services will meet your specific needs.
Warranty of Non-Infringement – that our services do not violate third-party rights.
Warranty of Title – regarding ownership of information or services.
11.3 Accuracy of Information
Icon Tours, LLC does not warrant the accuracy, completeness, or timeliness of:
Information on our website or in our communications.
Vendor descriptions or pricing.
Itinerary details or activity descriptions.
Photographs or images representing travel services.
Reviews or ratings from other travelers.
12. DISPUTE RESOLUTION AND GOVERNING LAW
12.1 Governing Law
These Terms and any disputes arising from your use of Icon Tours, LLC's services are governed by the laws of the United States, without regard to its conflict-of-law principles.
12.2 Jurisdiction and Venue
You agree that any disputes shall be resolved in the courts of the United States. You waive any objection to jurisdiction or venue in these courts.
12.3 Mandatory Alternative Dispute Resolution
Before pursuing any litigation, you agree to:
Make a good-faith effort to resolve disputes directly with Icon Tours, LLC by contacting our customer service.
Participate in mediation if Icon Tours, LLC requests it, using a mutually agreed mediator.
Allow a reasonable time period (at least 30 days) for Icon Tours, LLC to respond to your complaint.
12.4 Statute of Limitations
You must bring any claim against Icon Tours, LLC within 2 years of the date you discovered or should have discovered the issue giving rise to the claim. Any claims brought after this period are barred.
13. SEVERABILITY
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction:
That provision shall be severed.
The remaining provisions shall remain in full force and effect.
The severed provision shall be replaced with a valid provision that approximates the original provision's intent as closely as possible.
The invalidity of one provision shall not affect the validity of other provisions.
14. AMENDMENTS TO THESE TERMS
Icon Tours, LLC reserves the right to amend, modify, or revise these Terms at any time. Amendments will be posted on our website and will become effective immediately upon posting. Your continued use of our services following an amendment constitutes your acceptance of the amended Terms. If you do not agree with an amendment, you may request cancellation of your booking.

ACKNOWLEDGMENT AND AGREEMENT
BY SUBMITTING YOUR TRAVEL PLANNING FORM, YOU ACKNOWLEDGE THAT:
You have read and understood these Terms.
You understand that Icon Tours, LLC is not responsible for the performance of independent Service Providers.
You understand that travel involves risks that cannot be eliminated.
